DSGVO Art. 9
Article 9 GDPR classes health data as a special category: processing it is prohibited in principle and allowed only under narrow exceptions.
Even a destination such as a dialysis centre or a note such as wheelchair reveals a state of health and is therefore health data.
The exception a transport company usually relies on is Art. 9 (2) (h): processing for the provision of health care.
Breaches of Art. 9 fall into the upper fine bracket: up to 20 million euros or 4 percent of annual turnover (Art. 83 (5) (a)).
