GlossaryHow MitaBase does it
TERM
Zeiterfassungspflicht
The Zeiterfassungspflicht is the employer's duty to record the start and end, and so the length, of daily working time, which the Federal Labour Court derived from § 3 (2) no. 1 ArbSchG on 13 September 2022 (1 ABR 22/21).
It is a decision, not a judgment, and it prescribes no method; a handwritten sheet is enough in principle but the weakest evidence.
The Working Time Act itself still only requires recording the working time beyond eight hours (§ 16 (2) ArbZG, as of October 2026); an amendment is announced but not in force. Supervision lies with the states' occupational safety authorities (§ 17 ArbZG).
In MitaBase the driver clocks in, stamps the break and clocks out in the app, with location; the timesheet comes from that.
